Information about the Indian Trust Settlement (Cobell)

 

 

The Cobell settlement calls for two payments to be made to eligible class members. The Historical Accounting Class (or Stage 1) payments of $1,000 to each eligible class member started December 14, 2012 and are on-going. The current estimate is that the Trust Administration Class (or Stage 2) payment will be a base amount of $800. Individuals with an IIM account open between 1985 and September 30, 2009 may receive more than $800. This payment is separate from, and in addition to, the $1,000 payment to individuals in the Historical Accounting Class. The deadline for filing a claim for Stage 2 is March 1, 2013. Go to http://www.indiantrust.com/claim or call 1-800-961-6109 to file a claim.

Anyone who already receives Individual Indian Money (IIM) account statements or received a payment in Stage 1, the Historical Accounting Class, is already included in the Stage 2 class so there is no need to file a claim. However class members must make sure their contact information is kept up to date.

Payments to the Trust Administration Class (or Stage 2) will be made in 2013, possibly early fall, after a process of identifying all the class members is completed.

Important update from Class Counsel (Dec. 13, 2012):

On December 12, 2012, the Court filed an Order which directs the Claims Administrator to commence distribution of payments to the living members of the Historical Accounting Class no later than December 24, 2012. We anticipate commencing check distribution the week of December 17. Please note that payments to certain groups of Class Members (minors, persons with whereabouts unknown, individuals under legal disability, and adults in need of assistance) will be deposited directly into the Class Member’s IIM account. Payments to Class Members that are known to be deceased will not be mailed with the initial distribution. The Court has ordered that estate payments be distributed once the executor or trustee of the estate’s contact information has been provided through documentation or the Tribal or State probate order which would direct distribution has been received by the Claims Administrator.

May 16, 2012 update - There were no oral arguments scheduled for Tuesday, May 15, 2012, the judges will dispose|rule based on the information already presented. NO decisions have been made on the first appeal heard on 2/16/12 or the second appeal scheduled for 5/15/12. More to come when information is made available.
